Terms of Service

These terms govern your use of TravelStory. By creating an account or using the app, you agree to them. See also our Privacy Policy, which explains what data we collect and how we use it.
Who we are
TravelStory is operated by Paul Sherwood, trading as TravelStory, of Amherst, Harnham Lane, Withington, Cheltenham, Gloucestershire, GL54 4DD, United Kingdom. References to "TravelStory", "we", "us", and "our" in these terms mean Paul Sherwood. You can reach us at paul.sherwood@hostedcompanies.co.uk.
The service
TravelStory is a travel journal app: you record GPS tracks, upload photos, and organize them into journeys and trips, which you can keep private, share with friends, or make public. An optional live-tracking mode can share an in-progress trip too, behind a delay/distance buffer you set yourself - see our Privacy Policy's "Visibility and sharing" section for how that works.
Accounts and eligibility
You must be 18 or older to use TravelStory - this is an adult service, not one aimed at or believed accessible to minors. We ask for your date of birth at sign-up as a self-declaration, not an identity check (see our Privacy Policy's "Children's privacy" section for how to report an account you believe belongs to someone under 18). You're responsible for keeping your login credentials secure and for anything that happens under your account. TravelStory is currently invite-only and in private beta - if you signed the beta confidentiality agreement during sign-up, that agreement continues to apply alongside these terms for as long as it says it does.
Ownership
TravelStory - the app, the website, its design, and its underlying software - belongs to Paul Sherwood. These terms don't transfer any of that to you; you get a personal, non-transferable right to use the app as intended. The TravelStory name and logo are ours - don't use them to imply an endorsement or affiliation that doesn't exist.
Third-party place data
The optional Places layer displays data licensed from Foursquare, shown with "Powered by Foursquare" attribution wherever that data appears, per their terms.
Your content
You own the photos, tracks, journeys, trips, annotations, and comments you create. By posting them, you give TravelStory the rights needed to store, process, and display that content back to you and to whoever you've made it visible to (see "Visibility and sharing" in our Privacy Policy) - we don't use it for anything beyond running the app. You're responsible for making sure you have the right to post what you upload, and for the accuracy of what you write in comments and annotations.
Acceptable use
Don't use TravelStory to post anything illegal, infringing, or abusive, or to harass, impersonate, or deceive other users. Don't try to disrupt the service, scrape or bulk-extract other users' content, access the app or its API through automated means (bots, scripts, scrapers) outside of the app itself, or circumvent any access controls (including a journey or photo's visibility setting).
Photographs of other people.You must have the right to upload images of identifiable third parties, and must remove one on request from the person shown. This is a service built around holiday and family photos - respecting other people's preferences about being photographed and named is a condition of using it, not a courtesy.
Child sexual abuse material is never permitted, in any form, without exception.This applies regardless of context or intent. Report suspected CSAM immediately using the in-app reporting tools - see "Moderation and reporting" below. We remove it immediately on report and refer it to the relevant authorities, including the Internet Watch Foundation.
Reviews and check-ins.Don't post fake, paid-for, or malicious reviews or ratings of a real-world place. The businesses and people behind those places never agreed to be part of TravelStory, and a dishonest review affects them directly.
We reserve the right to remove content or restrict, suspend, or terminate an account that breaks these rules.
Moderation and reporting
Any user can report content they believe breaks these terms. Depending on the category and who reports it, we may hide the content immediately, pending review - a hide is temporary and reversible, and is not a finding that you've done anything wrong. Reports from identity-confirmed users, and reports in certain categories (illegal or dangerous content, sexual content, and content posted about someone without their consent), may hide content immediately on a single report; other categories may need more than one independent report first.
We commit to reviewing hidden content within 48 hours in the ordinary case. If a standard report goes unreviewed past that window, the content is automatically restored and the report escalated internally - your access to your own content is never held hostage to review capacity.
If your content is hidden or removed, you'll be told what happened and why (without being told who reported you), and you can appeal the decision with one tap - your appeal goes back into the review queue.
Reporting abusively - filing reports you know to be false, or repeatedly filing reports that turn out to be unfounded - is itself a breach of these terms, and may result in a warning, loss of the ability to hide content by reporting it, a temporary suspension of your ability to report, or account suspension or termination, depending on severity.
Some users may be granted moderator access to review reported content as part of keeping TravelStory safe. Moderators agree to confidentiality obligations covering what they see while reviewing reports, and never have access to more of your account or content than a report specifically concerns.
Free and Paid plans
A Free account can hold up to 3 journeys, each with up to 35 photos. Video isn't available on Free - a Paid account removes the journey limit, raises the per-journey photo limit to 1000 and adds video, and currently costs £5.00 a month. Every photo and video is subject to a file size (and, for video, length) limit that applies equally on both plans - see the FAQ for the current figures, since those are tuned more often than the plan limits above. Nothing is ever deleted for being over a limit - a journey with more photos/video than the Free plan allows just can't take new ones added to it until you're back under the limit or upgrade; your oldest 3 journeys always stay fully accessible on Free, and any journey created after those locks(becomes temporarily inaccessible, to you and anyone you'd shared it with) rather than being removed, if your account is on Free while holding more than 3. Upgrading, or deleting enough newer journeys to bring your account back under the limit, unlocks everything again immediately.
TravelStory does not currently take payment for the Paid plan - it's granted manually while the app is in private beta, at the price stated above. Billing is web-only via Stripe (not through the iOS or Android app), managed from your own Billingpage - card entry happens there directly, we never see or store your card number ourselves. Once real charging goes live: billing is monthly, auto- renewing until you cancel; cancelling keeps your Paid access until the end of the period you've already paid for, rather than stopping immediately; you can update your card or cancel yourself at any time from the Billing page; and your payment history is visible there too.
Before any charge is ever taken, we'll also publish the remaining detail this section doesn't yet cover - our refund policy, your statutory 14-day cancellation right under the Consumer Contracts Regulations, and what happens if a payment fails - and ask you to agree to them.
No warranty
TravelStory is still under active development and provided "as is", without warranty of any kind. Features may change, and the service may be interrupted or discontinued without notice. Keep your own copies of anything - photos, tracks, journeys - you can't afford to lose. Nothing in these terms affects your statutory rights as a consumer, including your rights in relation to digital content under the Consumer Rights Act 2015.
Limitation of liability
To the fullest extent permitted by law, TravelStory isn't liable for any indirect, incidental, or consequential loss arising from your use of the app, including loss of data or content. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't lawfully be excluded or limited.
Termination
You can stop using TravelStory and delete your account yourself at any time - see our Privacy Policy for how. It's immediate, with no grace period, so export a copy of your data first if you want one (also covered there). We may suspend or terminate an account that violates these terms, or, during the beta, for any reason with notice where reasonably possible. Where we terminate your account rather than you deleting it yourself, we'll give you a reasonable opportunity to export your data first unless the termination is for a serious breach of these terms (for example, CSAM) where immediate removal is necessary.
Changes to these terms
If these terms change, we'll update the effective date at the top of this page. While TravelStory is free, that's sufficient notice. Once any part of the service is paid, material changes will also be sent to you directly (email or in-app), with a right to cancel before they take effect if you don't agree to them.
Governing law
These terms are governed by the laws of England and Wales. If you live elsewhere, this doesn't take away any protection you're given by the mandatory consumer- protection laws of the country you live in, which you keep regardless.
Complaints
If something's gone wrong, tell us first at paul.sherwood@hostedcompanies.co.uk - we aim to respond within 30 days. You're not required to contact us before pursuing any other route available to you.
General
If any part of these terms turns out to be unenforceable, the rest still stands. These terms, together with our Privacy Policy and (if you're a beta tester) the confidentiality agreement you signed, are the entire agreement between you and us about using TravelStory. Not enforcing a term on one occasion doesn't waive our right to enforce it later. We may assign these terms (for example, if TravelStory changes hands); you may not assign your account or these terms to anyone else.
